Our Mediation Process

Understanding how mediation works and what to expect from our professional, structured approach to dispute resolution

What is Mediation?

Mediation is a voluntary process where people come together to find a mutually agreeable solution to a conflict or disagreement, under the guidance of an impartial, accredited mediator

Mediation can be used to resolve almost all types of civil and employment disputes, including:

  • • working relationship difficulties
  • • employment-related claims
  • • professional negligence
  • • personal injury
  • • breach of contract
  • • money disputes
  • • bankruptcy
  • • wills and probate disputes
  • • trust disputes
  • • charities disputes
  • • guardianship disputes
  • • land or property disputes
  • • landlord and tenant disputes
  • • neighbour disputes
  • • intellectual property disputes
  • • defamation
  • • construction disputes
  • • insurance claims

Voluntary Process

Participants choose to engage and can walk away at any time. There's no obligation to reach an agreement, ensuring all parties feel comfortable and in control of the process.

Safe and Confidential

Mediation provides a secure environment where parties can speak openly. The entire process is confidential, creating trust and encouraging honest dialogue.

Impartial Guidance

Our mediators are accredited by the Centre for effective dispute resolution (CEDR) to undertake commercial, employment, and workplace mediation. They remain neutral throughout the mediation process, guiding and coaching parties towards mutually agreed resolutions.

How the Process Works

A structured approach designed to facilitate understanding and resolution

1

Initial Consultation

We arrange confidential one-to-one video calls with each party (and their legal adviser if appropriate) to make introductions, explain the process, and understand backgrounds and potential solutions.

2

Mediation Agreement

A mediation agreement is signed by all parties and the mediator ensuring everyone understands the confidential and without prejudice nature of the process. Parties set aside a full day for the mediation.

3

Joint Opening Session

The day starts with a brief meeting where each party can speak uninterrupted about the issues and how they see them being resolved. Everyone then moves into smaller breakout rooms for private discussions.

4

Private Sessions and Resolution

Private rooms provide confidential space for participants to talk with the mediator. The mediator takes agreed messages between parties, explores situations, and coaches parties toward solutions, often encouraging parties to come together for further joint sessions as the day develops.

Why Choose Mediation?

Professional mediation offers clear advantages over traditional dispute resolution

1

Cost-Effective

Significant savings compared to litigation, with faster resolution times and fewer resources required

2

Flexible Control

Parties create solutions that work for their specific needs and circumstances

3

Preserves Relationships

Focus on collaboration helps maintain important business and personal relationships
